Criminal Background Screening Of Nursing Home Personnel

Nursing home personnel, their backgrounds, and their training is a critical issue with regard to the quality of care that nursing home residents receive.

Last year, the results of a paper concerning criminal background screening of nursing home employees was released.

This report was published in the Journal of Elder Abuse And Neglect and is titled “Evaluation of a Seven State Criminal History Screening Pilot Program for Long-Term Care Workers.”

In this paper, the findings of 247,198 background checks was discussed.

An excerpt from the article:

Radcliff’s team looked at results from a seven-state criminal history screening pilot program that started a total of 247,198 background checks.

The screenings cleared 158,207 applicants immediately.

The program disqualified 7,463 of the applicants — 3.7 percent of the total.

About 19 percent of the withdrew from the screening program voluntarily. The researchers speculate that some withdrew because they knew they would flunk the background screening.

Report Providing State Rankings Of Long-Term Care Indicators

Today (June 19, 2014) a press release for the report titled “Raising Expecations:  A State Scorecard on Long-Term Services and Supports for Older Adults, People with Physical Disabilities and Family Caregivers” was released.  This report is from AARP, The Commonwealth Fund, and The SCAN Foundation.

This report evaluates 26 indicators in five dimensions with regard to long-term care services among home care services, family caregiver settings, and nursing homes, and provides this detail for each state.

This report updates the “2011 LTSS Scorecard.”

With regard to the rating for Illinois, as seen in Exhibit 1 (page 9) Illinois ranks 15th among the states across all five dimensions.

Exhibit 2 (page 11) shows all 26 indicators, as well as statistical information including median values as well as “top” and “bottom” values.

With regard to nursing homes, among the information provided is Exhibit A12 on page 79, in which three aspects are shown for each state.  These aspects are “Percent of High-Risk Nursing Home Residents with Pressure Sores,” “Nursing Home Staff Turnover…,” and “Percent of Long-Stay Nursing Home Residents Who are Receiving an Anti-Psychotic Medication.”

The national value for each of these aspects is 6.2%, 39.5%, and 21.3%, respectively, as of the year indicated.

The Illinois value for each of these aspects is 7.0% (43rd in the nation), 38% (25th in the nation) and 25.1% (48th in the nation).

Of particular note is the statistics regarding “Pressure Sores,” alternately referred to as “Pressure Ulcers”  which, for those unaware, the report defines in the glossary on page 113.

Nursing Home Accident Involving Mechanical Lift

As discussed in the “Nursing Home Accidents” page, one type of common nursing home accident is that of falls by nursing home patients.

These falls can happen for a variety of reasons.  One reason has to do with accidents involving mechanical lifts utilized by nursing homes in order to lift and/or move nursing home residents.

Unfortunately, accidents involving these lifts do happen, especially if the lifts are not properly maintained.  A recent nursing home fall in Minnesota illustrates a nursing home accident involving one of these lifts.

This accident is discussed in the June 12, 2014 startribune.com article titled “Rochester nursing home at fault in resident’s fatal fall from lift.”

An excerpt:

A Rochester nursing home was found responsible for neglect after it failed to properly maintain mechanical lifts, causing a resident to fall from a harness and die in March, according to a Minnesota Department of Health investigative report released ­Thursday.

The 80-bed nursing home, Maple Manor Health Care & Rehabilitation, failed to implement safety precautions after experiencing ongoing problems with safety catches popping off a mechanical lift for moving patients called an EZ Lift. The facility had no records of any inspections or maintenance performed on the lifts, according to the Department of Health report.

According to the article, the nursing home resident suffered injuries, including fractures of the spine, and the patient died five days later at a hospital.

Although the above accident happened in a Minnesota nursing home, accidents involving mechanical lifts at nursing homes can and do happen in Illinois and Chicago nursing homes as well as nationally.

As the article also points out, “The misuse of mechanical lifts has been the cause of numerous deaths and injuries at senior homes across the nation.”  Many of the nursing home accidents involving these lifts include poor maintenance of the lifts as well as poor training in the use of the lifts.

Alleged Falsification Of Nursing Home Records

There is alleged nursing home abuse involving a New York nursing home.  In this alleged nursing home abuse, 17 nursing home workers face charges.

One aspect of these alleged charges, which is sometimes alleged in nursing home lawsuits, is that nursing home records were falsified regarding the care of the nursing home resident.

An excerpt from the wgrz.com article:

The CWA Union Local 1168 says six of those arrested are union members, and they were charged with allegedly falsifying documents and have been fired. “The falsification was related to patient care that was documented as being provided and allegedly was not,” according to a statement from the union.

While this alleged nursing home abuse happened in New York, the issue of alleged falsified nursing home records occurs in Illinois nursing home lawsuits as well as those nationally.  Of course, one factor that might motivate nursing homes to falsify records is to conceal nursing home abuse, neglect, or nursing home accidents that may have occurred during the care of a nursing home resident.

New Initiative Regarding Drug Prescriptions In Illinois Nursing Homes

Medications and prescriptions within Illinois nursing homes, as well as nationally, is an area of concern for many different reasons, including proper dosages, proper drug administration, and appropriate medications for nursing home patients.

On June 12, 2014, the Illinois Department of Human Services (IDHS) and the Illinois Department of Public Health (IDPH) announced the Prescription Monitoring Program (PMP) Long Term Care (LTC) initiative.  A couple of excerpts from the news release, as seen in enewspf.com, titled “June is Illinois Prescription Monitoring Program Month” :

The Illinois Department of Human Services (IDHS) and the Illinois Department of Public Health (IDPH) today announced the Prescription Monitoring Program (PMP) Long Term Care (LTC) initiative, an unprecedented opportunity to change the drug prescribing culture in nursing homes. Based upon concerns regarding substantial use of behavioral health medications within the nursing home population, IDHS and IDPH entered into an interagency agreement to reduce the use of chemical restraints and improve the quality of care.

“The Illinois Prescription Monitoring Program can help ensure the health and safety of long-term care residents by identifying medication errors and overuse or improper use of medications,” said IDPH Director Dr. LaMar Hasbrouck.  “IDPH is vigilant about the safety of all residents and this program is another tool in our toolbox to protect our loved ones.”

Nursing Home Deficiencies

A recent report regarding the quality of care in Louisiana nursing homes is illustrative of a variety of deficiencies and other related issues that may exist in other nursing homes nationwide, as well Illinois nursing homes and those in the Chicago area.

The report is discussed in the New Orleans Advocate article of June 10, 2014, titled “La. nursing homes rank poorly, report states.”

An excerpt:

Louisiana nursing homes rank among the worst in the nation in key quality measures, with high rates of bed sores and use of restraints among the 25,000 elderly and disabled people who live in them, the state legislative auditor reported Monday.

The report cited is dated June 6, 2014 and is titled “Utilization, Cost And Quality Of Care In Medicaid Nursing Facilities.” (pdf)

This report contains a variety of notable information.  Exhibit 12 (page 14) highlights “Ten Most Cited Nursing Facility Deficiencies,” which is illustrative of the types of deficiencies and hazards that can exist in nursing home care.  Among the areas listed are insuring that nursing facilities are free of nursing home accident hazards and provides supervision in order to prevent avoidable accidents.  As well, another area is the active management of infections so that they are not spread.

Another area of note is that which discusses the incidence of pressure sores (also commonly referred to as bedsores, bed sores, and pressure ulcers.)  As discussed on the Elman Law Group site ChicagoBedSoresLaw.com, the incidence of bed sores is important as “Bedsores are frequently caused by poor operating procedures, neglect, or carelessness in the care of nursing home residents and care patients.”

“Elder abuse is a hidden crisis,” said Jeanne Zieff, a social worker and coordinator of the CASC Elder Abuse Program.

“It generally refers to any of several forms of maltreatment of a person age 60 or older by someone who has a special, or ‘trusting’ relationship with the vulnerable adult,” she explained.

“The vast majority of abusers are adult children, grandchildren, or grandchildren of another family member. Elder abuse occurs behind closed doors,” Ms. Zieff continued. “For every one case reported, 24 cases go unreported.”

Elder abuse can also take place in nursing homes, as well.

Lawsuit Claims Chicago Area Nursing Home Sexual Assault

A lawsuit has been filed after doctors found a condom inside the stomach of a patient of an Illinois rehabilitation center.

The lawsuit was filed in Cook County Circuit Court on behalf of L.C. Scott, by Trixie Scott.

According to the lawsuit, in June 2012, L.C. Scott was a resident at Westchester Health And Rehabilitation Center, when he was taken to Adventist LaGrange Memorial Hospital because of suspected gastrointestinal bleeding and low hemoglobin levels.

An excerpt from the June 5, 2014 Chicago Sun-Times Voices article titled “Suit:  Condom found in nursing home resident’s stomach” :

When Scott underwent a procedure that examined parts of his digestive tract, a doctor found a condom inside his stomach, the suit said.

“Unfortunately, it look liked it was a condom and it was about 6 to 7 inches long with hardened material inside,” according to a doctor’s description of the procedure in a report, cited by the suit.

The lawsuit claims that the condom indicates that L.C. Scott was likely sexually abused.

This nursing home abuse lawsuit was filed against both the nursing home and the hospital, at which Scott had stayed 14 times in roughly a two year period.  The lawsuit claims negligence on the part of the nursing home and hospital, and they failed to implement proper security measures and failed to protect the patient from sexual abuse.

Nursing Home Seized By Regulators

The recent placing into receivership of a nursing home by the Minnesota Department of Health (MDH) highlights various types of neglect and violations that can occur in nursing homes both nationally as well as Chicago area nursing homes.

The action taken by the MDH is summarized in its press release of June 3, 2014, titled “MDH assumes control of Minneapolis nursing home to protect residents.”

A couple of excerpts from this release:

MDH used its emergency powers to assume control of the nursing home due to serious violations putting its residents at risk and an unacceptably high number of regulatory violations at the facility. MDH took action after management failed to correct numerous serious problems. In March 2014, MDH cited the nursing home for 47 violations. A follow-up inspection in May found 33 violations. Several violations were of a serious nature that posed a significant risk for residents. There are also concerns about the financial stability of the facility.

The 87-bed facility has been operated by Videll Healthcare Camden, L.L.C., as licensee, under a lease agreement with Irvine, California- based SABRA Health Care REIT, which purchased the facility in 2012. The facility has a mix of residents including those receiving senior care, dementia care, mental health care, and chemical dependency treatment. The management of the facility failed to maintain a basic level of safety and security, as demonstrated by the finding that two residents accessed drugs or alcohol while at the facility. Both of these residents required medical treatment and hospitalization in May, and one of them required intubation due to acute alcohol intoxication. There were also violations related to a wide range of legal requirements designed to ensure safe health care. After finding these violations in May, and until the receivership was ordered, the department increased monitoring and oversight to protect patients.

The startribune.com article of June 3, 2014, titled “Citing ‘dire problems,’ state seizes control of Mpls. nursing home” also discussing this nursing home regulatory action and the underlying conditions faced by the nursing home’s residents, including various forms of alleged nursing home neglect and other similar forms of nursing home operational shortcomings.

Variations In Patient Care At Hospitals

Many of the differences in the quality of patient care – as well as potential abuses and negligence – that can be encountered in nursing homes can be encountered in hospitals as well.

Today (June 3, 2014) the Wall Street Journal published an article titled “VA Hospitals Vary Widely In Patient Care.”  The article discusses a variety of issues, mostly pertaining to the difference in care and certain metrics regarding care at Veterans Affairs (VA) hospitals.

A couple of excerpts:

The rate of potentially lethal bloodstream infections from central-intravenous lines was more than 11 times as high among patients at the Phoenix facility than it was at top VA hospitals, data from the year ended March 31, 2014, show.

Those infections, called sepsis, can quickly cause multiple organ failure and kill an otherwise relatively healthy patient within days or even hours. The data don’t show what percentage of patients died as a result.

Variations in the quality of health care exist outside the VA system as well, though it is difficult to measure because relatively small numbers of hospital groups report a range of medical outcomes. But some experts in medical-quality measurement say the VA discrepancies stand out.
