Various sources indicate that falls are one of the most common types of Illinois nursing home accidents.  These falls also commonly occur in assisted living facilities and other long-term care facilities.

Also common are lawsuits over nursing home falls, especially if the falls appear to be caused by negligence of the facility.  Given the nature of falls by the elderly, often injuries can be significant – and in some cases the injuries may lead to death.  Broken hips are frequent injuries resulting from nursing home residents who trip or slip.

A recent Illinois wrongful death lawsuit, featured in the Madison Record article of November 3, 2015, titled “Nursing home seeks to transfer wrongful death suit,” serves as an example of a wrongful death lawsuit that alleges negligence occurred in the repeated falls of a nursing home resident.

Additional details can be seen in the Madison Record article.

Cook County Lawsuit Involving Bedsore Development

The development of bedsores (also commonly referred to as bed sores, pressure sores, pressure ulcers, and decubitus ulcers) are of great concern, for two primary reasons.

First, bedsores are a major health concern both for the direct health impact and indirect (through complications) hazard they can potentially cause to one’s health.  There are a range of adverse medical conditions that can occur due to bedsore formation.

There are many steps that can be taken to prevent bedsores.  Should bedsores develop, it is critical that they are immediately and properly treated.

Second, the development of bedsores is often a sign of neglectful health care.  This is especially so if the bedsores worsen in severity, which is likely to happen if they are not promptly and properly treated.  Unfortunately, as seen in many examples, bedsores often worsen in severity, causing many adverse medical conditions, and in some cases lead to death.

A recent lawsuit has been filed in the Circuit Court of Cook County regarding the alleged development of pressure sores, which, according to the lawsuit, became infected and led to the death of James Mason.

The lawsuit is described in the November 16, 2015 Cook County Record article titled “Daughter accuses Lexington Center of negligence in father’s death.”  An excerpt:

The lawsuit states the defendant’s staff failed to turn Mason periodically to avoid pressure sores and did not keep his doctor appraised of his condition.

Additional details and possible updates concerning this lawsuit can be found in the Cook County Record article mentioned above.

Due to the high incidence and severity of injury that these falls can cause, Illinois nursing home falls are discussed extensively on this site.  These falls are one of the most common types of Illinois nursing home accidents.  These falls, of course, also occur in various other types of long-term health care facilities, including assisted living facilities and retirement homes.

Additional Discussion Regarding Arbitration Agreements

Pre-dispute arbitration clauses as they relate to nursing home care was discussed in the October 20, 2015 post titled “Pre-Dispute Arbitration Clauses.”

For those who are interested in another recent discussion of pre-dispute arbitration clauses, the New York Times article of October 31, 2015, titled “Arbitration Everywhere, Stacking the Deck of Justice” also discusses the issue from a broader perspective.

An excerpt:

The consequences of arbitration clauses can be seen far beyond the financial sector. Even lawsuits that would not have been brought by a class have been forced out of the courts, according to the Times investigation. Taking Wall Street’s lead, businesses — including obstetrics practices, private schools and funeral homes — have employed arbitration clauses to shield themselves from liability, interviews and arbitration and court records show.

Thousands of cases brought by single plaintiffs over fraud, wrongful death and rape are now being decided behind closed doors. And the rules of arbitration largely favor companies, which can even steer cases to friendly arbitrators, interviews and records show.

Additional details and possible updates can be seen in the New York Times article mentioned above.
