Report Concerning Sexual Abuse And Sexual Assault At Nursing Homes

Sexual abuse and sexual assault that occurs to residents of nursing homes continues to be a significant concern.  As seen in many statistics and news stories, as well as allegations made in many nursing home lawsuits, sex crimes committed against nursing home residents are numerous.  This abuse and rape is often committed by nursing home staff as well as by other nursing home residents.

Recently, CNN has published an investigative report titled “Sick, dying, and raped in America’s nursing homes.”

Notable excerpts include:

Some of the victims can’t speak. They rely on walkers and wheelchairs to leave their beds. They have been robbed of their memories. They come to nursing homes to be cared for.

Instead, they are sexually assaulted.

The unthinkable is happening at facilities throughout the country: Vulnerable seniors are being raped and sexually abused by the very people paid to care for them.

It’s impossible to know just how many victims are out there. But through an exclusive analysis of state and federal data and interviews with experts, regulators and the families of victims, CNN has found that this little-discussed issue is more widespread than anyone would imagine.

Even more disturbing: In many cases, nursing homes and the government officials who oversee them are doing little — or nothing — to stop it.

Sometimes pure — and even willful — negligence is at work. In other instances, nursing home employees and administrators are hamstrung in their efforts to protect victims who can’t remember exactly what happened to them or even identify their perpetrators.

The report cites various statistics – including those for Illinois nursing homes – regarding sexual abuse and assaults.

Also, the report discusses the challenges in identifying and investigating possible instances of crimes.  Another excerpt:

Many nursing home employees promptly report abusers to authorities as required by federal law and assist in the investigations. But in numerous examples of abuse uncovered by CNN, the facilities themselves have made it possible for violent rapes and sexual assaults to go unchecked.

In these facilities, allegations are routinely questioned or dismissed because victims have cognitive conditions such as Alzheimer’s. Workers often lack the specific training needed to spot sexual abuse — keeping reports of abuse from ever reaching authorities. And the reputation and safety of the facility may take priority: There’s often a fear that bringing investigators into a cash-strapped facility may expose other issues, threaten a nursing home with closure or open the door to costly lawsuits.

Most sinister of all are administrators and employees who actively impede investigations.

Pressure Ulcers Cited In Illinois Lawsuits

As frequently discussed on this site, pressure ulcers (also frequently referred to as pressure sores, pressure injuries, bedsores, and bed sores) can – especially if not treated promptly and properly – lead to a variety of adverse health consequences that can directly or indirectly lead to the death of those who have them.  One of the health complications that can arise is that of sepsis, which is further discussed on the sepsis page.

Many Illinois lawsuits have been filed over the development of pressure ulcers in nursing home patients, as well as those that have developed in residents of other long-term health care facilities, such as assisted living facilities.  Many of these lawsuits claim negligence in care, either for allowing such pressure sores to develop and/or in not taking appropriate action once pressure sores have developed.  Various lawsuits are wrongful death lawsuits, claiming that the development and worsening of pressure ulcers have led to the death of the patient.

One such lawsuit is seen in the Madison Record article of January 2, 2017, titled “Woman alleges decedent developed pressure ulcers in nursing home.”  An excerpt, referring to the decedent Betty Elaine Hamilton:

According to the complaint, the plaintiff alleges that during the time that Hamilton was a resident at the defendant’s facility, she suffered from pressure ulcers and infections.

McGovern alleges the defendant failed to provide necessary care and services and failed to develop and implement a comprehensive care plan.

The article also references alleged violations of the Illinois Nursing Home Care Act.
