Lawsuit Filed Regarding Fatal Illinois Nursing Home Accident

The March 23, 2015 post, titled “Investigation Of Illinois Nursing Home Resident’s Death,” discussed the circumstances surrounding the March 12 death of Juanita Simmons at an Illinois nursing home, the Midwest Rehabilitation and Respiratory Center in Belleville.  This nursing home accident allegedly involved Simmons falling down a flight of stairs in a wheelchair after a fire door was opened.  Additional allegations regarding the accident, regarding various aspects as to how the nursing home handled the situation, have also been publicized.

An Illinois nursing home lawsuit has been filed regarding this fatal incident.  The lawsuit was filed April 2 in St. Clair Circuit Court, against Midwest Rehabilitation and Respiratory Center LLC.

An excerpt from the April 22, 2015 Madison Record article titled “Nursing home accused of misrepresenting facts in patient’s fatal stair fall“:

The complaint argues that the defendant removed the decedent’s body from the scene of the accident without notifying authorities and further misrepresented the facts by claiming the facility had notified Simmons’ daughter.

The suit states that as a result of the accident, Simmons endured pain and suffering, mental anguish, emotional distress, loss of dignity, and disability in the time up until her death.

Roth claims the defendant violated the Illinois Nursing Home Care Act and the Illinois Survival Act. She also alleges conscious pain and suffering, wrongful death and spoliation of evidence.

Lawsuit Filed Regarding Illinois Nursing Home Accident

There has been a lawsuit filed against an Illinois skilled nursing facility (SNF) over an alleged nursing home accident.

The underlying accident involved a Cedar Ridge Health and Rehab Center resident, Timothy J. Bates, who alleges that he slipped out of his wheelchair while riding in a shuttle van, which caused injuries and other harm, including pain and suffering.  The lawsuit is filed against Covenant Care Midwest (dba Cedar Ridge Health and Rehab Center in Lebanon, IL) and Cynthia Sanchez.

This lawsuit is discussed in the March 25, 2014 Madison-St.Clair Record article titled “Man with traumatic brain injuries suffers further injuries during van ride.”

An excerpt from the article:

Bates blames the defendants for causing his injuries, saying they negligently failed to place him in the van in a safe manner, failed to adequately secure him in the van, drove in such a manner that he slid out of his seat, drove too fast and failed to reduce the van to prevent him from slipping.
