Police arrested Moore nine days later, charging him with sexual abuse of a person incapable of giving consent and with endangering the welfare of a physically disabled person.

The police report filed after Moore’s arrest said the woman had told Moore to leave her room “multiple times” before he came in at midnight, pulled down her blankets and molested her.

Sometimes pure — and even willful — negligence is at work. In other instances, nursing home employees and administrators are hamstrung in their efforts to protect victims who can’t remember exactly what happened to them or even identify their perpetrators.

Many nursing home employees promptly report abusers to authorities as required by federal law and assist in the investigations. But in numerous examples of abuse uncovered by CNN, the facilities themselves have made it possible for violent rapes and sexual assaults to go unchecked.

In these facilities, allegations are routinely questioned or dismissed because victims have cognitive conditions such as Alzheimer’s. Workers often lack the specific training needed to spot sexual abuse — keeping reports of abuse from ever reaching authorities. And the reputation and safety of the facility may take priority: There’s often a fear that bringing investigators into a cash-strapped facility may expose other issues, threaten a nursing home with closure or open the door to costly lawsuits.

Most sinister of all are administrators and employees who actively impede investigations.

Alleged Sexual Assault In Illinois Nursing Home

There have been two recent articles concerning instances of alleged sexual assaults at nursing homes.  The first is seen in the July 30 lancasteronline.com article titled “Man gets 8-20 years for sexually assaulting Alzheimer’s patient in nursing home.”  In this case, the underlying sexual assault happened in 2013, and involved one nursing home resident sexually assaulting another resident.

Another alleged nursing home sexual assault happened in 2011, in a nursing home (Crystal Pines Rehabilitation and Health Care Center)  in Crystal Lake, Illinois.   The underlying alleged sexual assault was summarized in the October 26, 2011 ChicagoSexualAbuseLawyerBlog.com (published by Elman Law Group) post titled “93-Year-Old Woman Allegedly Sexually Assaulted In Crystal Lake, Illinois Nursing Home.”  The trial regarding this incident was recently featured in the July 31, 2014 TribLocal Crystal Lake article titled “Mistrial for man accused of nursing home sexual assault.”

Possible Sexual Assault At Nursing Home

A recent situation at a Florida nursing home has raised concerns of a possible sexual assault.  Concerns arose after the nursing home resident – a 75-year-old woman with Alzheimer’s and dementia – complained to her daughter that she was pregnant and experiencing pain in her pelvic region.  Upon being taken to a medical facility, she was found to have a sexually transmitted disease (STD), which is one sign that can indicate a sexual assault has occurred.  An investigation began.

Sexual Abuse At Skilled Nursing Facility

One form of nursing home abuse is that of sexual abuse.  Sexual abuse in nursing homes (or assisted living facilities, hospitals, etc.) has occurred either by other patients or by nursing home staff.

Sexual abuse by nursing home staff is alleged to have recently happened in a California nursing home.

In this alleged incident, an employee at the Auburn Oaks Care Center – a skilled nursing facility – is alleged to have exposed himself to two nursing home residents, kissed them against their will, and “sexually touched” them.

The employee, Marlo Santos Quinton, 57, of Auburn, a nursing assistant, was arrested on May 20, and is accused of elder abuse and indecent exposure.

Quinton had worked at the Auburn Oaks Care Center for 12 years.

The Placer County Sheriff’s Office began an investigation after the women reported the alleged incidents.
